Congratulations to GWM’s Joe Fasi for the Florida First District Court of Appeal’s ruling in Philip Morris USA Inc. v. Jo E. Freeman.  At trial, Philip Morris moved for a directed verdict on the grounds that Plaintiff’s decedent had purportedly filed suit two years after his death.  The trial court denied the motion, and while Fasi and the defense team defeated Plaintiff’s claim for punitive damages, the jury awarded compensatory damages.  On appeal, the appellate court ruled that the trial court erred in not granting Philip Morris’s directed verdict motion and reversed the compensatory damages award.
